These Terms of Service (the "Terms") set out the conditions for using the smartphone/web game "Manusummon" (the "Service") provided by Kyohei Miyabe (the "Operator"). By using the Service, you agree to be bound by these Terms.
Article 1 (Application)
These Terms apply to all relationships between the Operator and users in connection with the use of the Service.
Article 2 (Account Registration)
1. Users may create an account for the Service using an email address and password.
2. Users shall keep their registration information current and accurate.
3. Users may optionally enable TOTP-based multi-factor authentication (MFA). Users are solely responsible for managing their password and MFA, and the Operator is not liable for unauthorized use by third parties.
Article 3 (Use of Generative AI Features)
1. Based on text or drawings entered by the user, the Service uses generative AI (an API provided by an external generative AI service provider) to generate pixel-art images, names, backstories, elements, and skills for monsters, heroes (avatars), and equipment.
2. Content entered by users is checked in advance for inappropriate content, personal information, and infringement of existing characters' rights; generation may be refused where such issues are detected.
3. Generative AI calls are subject to a quota that varies by distribution platform and subscription plan. Once the quota is reached, additional use may be unlocked by watching an advertisement or by subscribing (the ad-unlock feature may not yet be available).
4. The rarity of generated monsters, heroes, and equipment is determined with a probabilistic element on each generation. A subscription or watching an advertisement only adds to the number of generations available (the quota) and does not guarantee any particular rarity or outcome.
5. Copyright treatment of generated images, backstories, and game data is as separately determined by the Operator.
Article 4 (Prohibited Conduct)
Users shall not, in using the Service:
1. Violate any law or public order and morals.
2. Infringe the rights of others (copyright, trademark, portrait rights, privacy, etc.).
3. Attempt to generate content imitating real persons, organizations, or characters from existing copyrighted works.
4. Submit content containing personal information as input to the generative AI (such input is blocked before submission if detected).
5. Engage in unauthorized use, reverse engineering, or unauthorized access to the Service.
6. Defame or harass other users.
Article 5 (Reporting and Removal of Content)
1. Users may delete monsters and equipment they created at any time from the Codex and equipment list screens.
2. If a user finds inappropriate content created by another user, they may report it via the in-app inquiry form. The Operator will review the report and take appropriate action.
Article 6 (Restriction of Use / Account Deletion)
1. The Operator may restrict use of the Service or delete a user's account without prior notice if the user violates these Terms.
2. Users may delete their own account at any time from the Account Settings screen. Upon account deletion, data associated with that user (account information, generated monster/hero/equipment data, images, etc.) will be deleted.
Article 7 (Paid Features / Subscriptions)
1. In addition to the free usage tier, the Service may offer paid features such as additional unlocks via advertisements and subscription plans (e.g., the Supporter plan), including features still in preparation.
2. Subscription pricing is the amount shown on the purchase screen of the App Store/Google Play or within the app at the time of purchase.
3. Subscriptions renew automatically at the end of each billing period unless canceled by the user. Cancellation can be done from the subscription management screen of the store you subscribed through (App Store/Google Play) or from the Account Settings screen within the Service.
4. Amounts already paid are, in principle, non-refundable (including on a pro-rated basis), except where a refund is required by law.
5. Where a minor uses a paid feature (makes a purchase), the minor shall do so with the consent of a parent or other legal guardian, and the Operator will treat such consent as having been obtained.
6. The legal disclosure required under the Specified Commercial Transactions Act is provided on a separate page within the app.
Article 8 (Disclaimer)
1. Except in cases of willful misconduct or gross negligence, the Operator is not liable for any damages arising from changes to, suspension of, or termination of the Service.
2. Output from the generative AI may include unintended expressions. The Operator does not fully guarantee the content of such output.
Article 9 (Changes to These Terms)
The Operator may change these Terms without prior notice to users where the Operator deems it necessary. The revised Terms take effect once displayed within the Service.
Article 10 (Governing Law / Jurisdiction)
These Terms are governed by the laws of Japan. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Operator's location.
